Town Sues Sheriff Over Bingo

HUNTSVILLE -- A financially strapped north Alabama town has sued the Madison County sheriff saying that raids of two bingo halls in Triana eliminated a major source of tax income.

The seizure of machines in a March raid took away the town|s right to collect taxes from charitable bingo organizations, including taxes on facilities and machines, according to the suit filed Friday in Huntsville|s federal court.

That income had outstripped collections from property, sales, liquor, tobacco and TVA taxes combined in the 656-resident town with a population that is 95 percent black, the suit said.

The bingo halls haven|t reopened since the raid led by Sheriff Blake Dorning that led to the confiscation of more than 300 electronic bingo machines and nearly $175,000 from the two bingo halls that were allegedly used for illegal gambling.

Julian Butler, a Huntsville attorney representing the sheriff, declined to comment on the federal suit. Butler has asked for dismissal of a suit filed by the town in Madison County Circuit Court against the sheriff.

Butler said any action by the sheriff involves the enforcement of Alabama laws.
